These Terms and Conditions of Sale exclusively regulate the offer,
transmission and acceptance of purchase orders relating to products on
shopfatal.com between the users of shopfatal.com and Fatal.
Fatal shall under no circumstances be deemed liable
for the supply of services provided by third parties or for the
execution of e-commerce transactions between the users of shopfatal.com
and third parties.
Buying on shopfatal.com Once we have received your order electronically, your order is considered submitted.
The unit price indicated in the order form does not include duties, taxes and fees you may be charged by your local authorities.
The
order form will be filed in our data base for such a period of time
required in order to process your order.
Fatal reserves the right to cancel orders that do not give sufficient guarantees
of payment, orders for
products that are no longer available, or orders which are incomplete or incorrect. In the above cases, we will notify you via e-mail that the the contract has not been executed and that
Fatal has not carried out your order.
If the products displayed on shopfatal.com are no
longer available once we have
received your order form, we will inform you via e-mail.
If payment has been submitted for items that
are no longer available, Fatal will refund you the sum paid to the
original credit card charged.
By submitting an order form and
contracting with us, you unconditionally accept the provisions of these General Terms and Conditions of Sale, as well as of the further conditions and policies contained on
shopfatal.com.
For international
orders, please note that all prices are exclusive of duties, taxes or fees that you may need to pay to local authorities. Fatal is not able to advise on the amount of duties and
taxes that may be owed to local authorities. These amounts should be
considered above and beyond your order total.
Products
Products offered on shopfatal.com have limited availability and are subject
to supply. Descriptions, specifications, colors and pricing are subject
to change at any time and without any notice. Prices displayed on the
site are quoted in U.S. Dollars.
The
main characteristics of products are shown on shopfatal.com on each product page. The items offered for sale on shopfatal.com may differ slightly to the actual garments in terms of image and
colors because your internet browser or your computer's monitor settings.
Pre-Orders
Because of the nature of the pre-order process, once your order has been placed we are unable to cancel. Returns Fatal will only accept for return merchandise purchased at full retail price. Items purchased at discount or on sale are not returnable. We reserve the right to refuse a return when return conditions are not met. Fatal will accept for
return merchandise purchased from us and sent back in the
original brand new and unworn condition. Please notify us via email at returns@shopfatal.com within 2 days of receiving your merchandise. Return package must be sent out and postmarked within 7 days of your receipt of the package in order to be eligible for refund. Sale items are not returnable. All tags must be attached and
packaging must be intact. Please insure your package and provide a
delivery confirmation number. Fatal will not issue refunds or
exchanges for items that have been lost during the return process or are damaged and unsaleable upon receipt. Once
your item is inspected and it is determined to have met policy requirements, we will issue a refund to
your credit card less shipping costs. If any item is sent back that
does not meet the return criteria, you will not receive a refund and
your item will be sent back to you and your credit card will be billed
for the shipping charge. In cases where free shipping has been applied, original shipping cost will be deducted from refund. Instructions for refund are as follows: - Please send an email to returns@shopfatal.com within 3 days
of receipt of item to let us know you would like to request a return.
Please include your order number and the name of the item(s) you wish
to return. We will send you an email with and RMA number. - Item
must be prepaid for shipping and return postmarked within 7 days of
delivery to be eligible for refund. Any returns postmarked after the 7
day window will be refused - Sale priced items are non-returnable - Hosiery items are non-returnable -
Item must be in its original condition with all packaging and tags
intact to be eligible for refund. Any items that show signs of use,
wear, wash or damage will not be refunded and will be sent back to you
at your expense. - Please insure your package for unpredictable damages and losses. Fatal will not be responsible for refund if your package is not delivered to us, or is not delivered in saleable condition. - Shipping costs are not refundable and are the sole responsibility of the customer. Original shipping costs are not refunded. -Duties and taxes paid are not paid to Fatal, and therefore not the responsibility of Fatal to refund. -If
any package is returned without prior authorization, Fatal reserves the
right to refuse the package. If we have to send the package back to
you, you will be charged for return shipping costs paid.
Getting your refund:
After
we receive, process and confirm that your return item meets all Return
Policy requirements, you will receive an e-mail notifying you that your
refund has been processed. Refunds are processed within approximately
3-5 business days of our receipt of your merchandise. Your refund will
be credited back to the same card used to make the original purchase. We do not refund delivery costs or the duties/taxes of your country - only the amount paid for the item you have decided to return. Refund times will depend on your credit card company's policies.
** By
purchasing through this website, you agree to pay all taxes and duties
assigned by the destination country. Should you refuse or neglect to
pick up your package for any reason, Fatal will not assume
responsibility and will not issue a refund. No exceptions will be made
to this policy.

Customs and Duties on international orders
For
our customers outside of the U.S., please be aware that upon arrival in
your country, the items you have purchased may be subject to customs
fees which may include taxes, duties & processing fees. These fees are the
responsibility of the recipient and are not under Fatal’s
control. We recommend you verify with your local customs office for
more information about these fees before you place an order. Fatal is
unable to estimate customs fees, taxes, duties, etc. so please contact
your local authorities or customs office for detailed information.
Both
the item prices as well as the shipping charges you pay to Fatal are exclusive of customs fees, import taxes, duties, etc. These costs should be considered outside of your order total.
We do not refund for returned packages because of refusal to pay import taxes or failure to pick up merchandise. Please note that no exceptions will be made to this policy.
Lost packages: If your package has not been received within 8 weeks for international delivery, we will reimburse your order total in full. We are able to place a trace on packages via USPS after 14 business days.

Payment of product prices and relevant shipping costs can be made via credit card and debit card through our processor, and through Google Checkout.

Shipping and Delivery
We are not responsible for delivery time due to service failure of carrier. We are not responsible for packages that have been returned to us as undeliverable. If you fail to receive your package due to not being present at delivery or re-delivery, you agree to pay the shipping cost to re-send items to you. All orders are shipped only to the billing address of the credit card used for payment. If you would like your order shipped to an alternate address, please use Google Checkout.
